Charter agreement.

A charter agreement is the contract for a private flight, setting out the aircraft type and registration, the itinerary, the price and what it includes, payment terms, cancellation charges and liability. In broker-arranged charters the agreement may be between the customer and the broker, or the customer and the operator, and should identify the operator holding the air operator certificate.

What does Charter agreement mean in practice?

Read the charter agreement before paying, and read the cancellation clause twice.

Typical agreements charge a rising percentage of the price as departure approaches, and some are non-refundable once the aircraft has been positioned. Check what is included: fuel, crew, handling, landing fees and de-icing are sometimes in, sometimes billed afterwards as disbursements. Check whether the price is fixed or hourly and subject to adjustment. Check what the operator's obligations are if the aircraft becomes unserviceable, and whether a replacement aircraft of similar type will be offered at no extra cost. In the United States, Part 295 requires a broker to disclose, before the flight, the operator's corporate name, the capacity in which the broker acts, and whether the broker carries liability insurance covering you. Outside the United States, no equivalent rule applies to brokers, so ask for the same information in writing. A broker that will not name the operator is a warning sign.
